Services Provided: Therapeutic Massage, Bodywork, Meditation, Reiki Energy Healing, and The California Clarity Method™ Coaching.
Location: 2388 N Sunrise Way, Palm Springs, CA 92262 (and designated Outcall locations)By booking an appointment, paying for a service, or engaging in any session (in-person or virtual) with Gustavo Amorim and Native Amorim, the Client explicitly agrees to the following terms and conditions:1. ZERO TOLERANCE POLICY FOR INAPPROPRIATE BEHAVIOR• Strictly Professional: All sessions are strictly professional, non-sexual, and therapeutic in nature.
• Immediate Termination: Any illicit, sexually suggestive, aggressive, or otherwise inappropriate behavior, remarks, or advances made by the Client will result in the immediate termination of the session.
• Financial Consequence: In the event of termination due to inappropriate behavior, the Client will be charged the full price of the booked service, and absolutely no refunds will be issued.
• Future Bans & Reporting: Gustavo Amorim reserves the right to permanently ban the Client from future bookings and, if necessary, report harassment or threatening behavior to local law enforcement.2. RIGHT TO REFUSE SERVICE• The Practitioner retains the absolute right to refuse service or terminate a session at any time if safety concerns arise, if boundaries are violated, or if the Practitioner feels uncomfortable for any reason.
• Outcall Services: For mobile or outcall sessions, the Client must provide a safe, sanitary, and appropriate working environment. The Practitioner may terminate the service immediately, retaining full payment, if the environment is deemed unsafe, unsanitary, or suspicious.3. HEALTH HISTORY & MANDATORY DISCLOSURE• The Client is strictly responsible for providing accurate and complete health information prior to any treatment.
• Failure to disclose medical conditions, surgeries, allergies, or medications drastically increases the risk of injury.
• Native Amorim and Gustavo Amorim shall not be held liable for any adverse reactions, injuries, or complications arising from the Client's failure to fully disclose their medical history or from providing false information. The Client must update the practitioner regarding any changes in their medical condition.4. SCOPE OF PRACTICE & NO MEDICAL ADVICE• Massage therapy, energy healing (Reiki), meditation, and coaching are intended for relaxation, stress reduction, and muscular relief.
• These services are not a substitute for medical diagnosis, psychiatric care, or medical treatment.
• Gustavo Amorim does not diagnose illnesses, treat specific medical diseases, or prescribe medications.
• Coaching Disclaimer: "The California Clarity Method™" provides coaching and educational guidance only. It is not licensed therapy, psychology, or medical care, and the Client assumes full responsibility for their own decisions and outcomes.5. ASSUMPTION OF RISK & LIABILITY ACKNOWLEDGMENT• The Client acknowledges that results vary between individuals and that bodywork involves inherent physical interaction and pressure application.
• The Client voluntarily assumes all risks associated with receiving massage therapy, outcall services, or participating in coaching and meditation.
• The Client completely and voluntarily releases Native Amorim, Gustavo Amorim, and any associated representatives from any and all liability, claims, or lawsuits for injury, damages, or loss, except in cases of proven gross negligence.
• Indemnification: The Client agrees to indemnify and hold harmless Gustavo Amorim and Native Amorim from any legal fees, costs, or damages resulting from baseless claims or lawsuits brought forward by the Client.6. CONSENT & BOUNDARIES• The Client explicitly consents to the therapeutic touch required for the agreed-upon service.
• The Client has the right and responsibility to stop the session at any time or inform the therapist immediately of any pain or discomfort.
• Personal boundaries must be strictly respected by both parties. Any unauthorized photography, audio recording, or video recording of Gustavo Amorim or the session is strictly prohibited and will result in immediate termination and potential legal action.7. CANCELLATION, NO-SHOW & FINANCIAL POLICY• Appointments are highly customized and reserved specifically for the Client.
• 24 hours Cancellations made with less than the required notice, or failure to appear for a scheduled appointment (No-Show), will result in a charge up to the full cost of the scheduled service.
• Chargebacks filed fraudulently for services rendered, or for sessions terminated due to the Client's inappropriate behavior, will be legally disputed using this signed agreement and the Client Intake form as proof of service and consent.8. PRIVACY & CONFIDENTIALITY• Client information is confidential and used solely for treatment and operational purposes.
• Information will not be shared with third parties, except as required by law, or to defend Native Amorim/Gustavo Amorim in the event of a legal dispute, chargeback, or safety threat initiated by the Client.9. ELECTRONIC SIGNATURE & LEGAL BINDING• By booking a service online, signing via the client portal, or checking the "I Agree" box on the Native Amorim website, provided by google forms, the Client digitally signs this agreement in accordance with the U.S. ESIGN Act.
• The Client certifies they have read, understood, and voluntarily agreed to these terms.
